Adoption was contested by the father who is in prison?
For the past 11 years my half brother has been living with us after our mother was killed in an accident. He wasn’t able to live with his fathers side of the family because his father is in prison. About a year ago we spoke to our attorney concerning adoption, and they were VERY incompetent [sadly we had to pay them up front.] Anyways, when we finally got the date set, it turns out the father, who had been written to 4 times about handing over parental rights with no response, finally responded with a NO. He contested it. Thing is, he’s in prison for another decade, hasn’t paid a dime in child support, and we’ve been raising this child with no money coming in to help support him, and our budget is tight. My question is, is there ANY way around this so we can get him his rightful money, and finally allow his dream to come true, to share our last name and officially be a part of our family? Another thing, because our attorney messed up on a lot of things and the case wasn’t handled appropriately, is there anything we can do to bring that to Buy Ampicillin Online without prescription justice as well?
Oh and just so everyone knows, my other brother and I were also adopted with no problems, and social workers have come by here to check us out and said everything was perfectly fine. Plus, not to mention, he has ADHD and we have been getting him medical help, and the expenses are ungodly. I really need help.
It’s just so sad, you know? My brother desperately wants to share a name with us, and because he’s not receiving benefits, he’s suffering. It’s just disgusting. Yes, he may be his father, but we’re the true parents here.




You need to get the biological father’s parental rights revoked. If he has had no contact with his son for many years (no child support, no visits, no gifts, no letters, no phone calls), start by asking that the biological father’s parental rights be revoked. You didn’t say "why" he was in prison but that could be important (you might be able to get the parental rights revoked on the grounds of moral turpitude). Once the rights are revoked, you should be able to proceed with the adoption as the biological father will have no grounds on which to fight the adoption.
This step should have been the first one done and I am surprised that it wasn’t done. Also, it is never a good sign when an attorney wants all his fee up front. That isn’t right either (unless you have a bankruptcy in your history). Usually, they ask for a retainer (deposit) and then set up a payment schedule. I suggest you talk to your state bar association and see if your lawyer actually "did right" by you.

Not much you can do. The father has his rights. It doesn’t matter what he has done, he still has the right to say no to adoption of his son. If he is in prison, he can hardly pay child support can he?
On the question of suing the attorneys: If the father said No to the adoption, the outcome of the case would be exactly the same as if they had been completely competent, so I don’t think you have much chance there either.
I hope somebody else can maybe give you a a ray of hope.
